Tickets purchased from online points of sale in Spain include home delivery of the wristband. The designated online points of sale are those listed above: MAD COOL TICKETS.
If due to health, emergency, safety, or logistical reasons, it is not possible to send the wristband to the purchaser’s home, for causes beyond the control of the Organisation, it may be collected at the Festival entrance.
6. Right of Admission and Festival Access
The Buyer shall have the ticket in a manner that can be read by the electronic validity control of the code printed on it, for the purpose of facilitating and speeding up admission and entry to the Festival at access controls.
The Organisation’s staff shall check the ticket code at the time of exchanging it for the wristband and will place the wristband correctly on the wrist of the ticket holder. Likewise, they shall check the wristband chip at the venue entrance for all attendees. Once the ticket has been exchanged for the wristband in the designated area, the wristband becomes the element that certifies the acquired right.
Pursuant to the provisions of Law 17/1997, of 4 July, on Public Shows and Recreational Activities, the right of admission shall be used by the Organisation as an effective instrument to prevent violence and disruptions to the normal development of the Festival, as well as any other situations that could pose a real and serious danger to users attending the event.
The above does not imply that admission to the Festival will be automatically denied in such cases, nor for the entire duration of the Festival, but only in cases that may pose a real and serious danger to users attending the Festival and to the Festival itself, while such attitudes or circumstances persist.
The exercise of the right of admission may not, under any circumstances, entail discrimination based on birth, race, sex, religion, opinion, disability, sexual orientation, gender identity, or any other personal or social condition or circumstance of users, both in relation to access conditions and to remaining on the premises and the use and enjoyment of the services provided therein.
At the venue entrance, access with objects that may be considered dangerous by the Organisation or prohibited by current regulations shall not be allowed. By way of example, but not limited to:
• Any object that may cause harm to the physical integrity of attendees, such as sharp or blunt objects, glass objects, aluminium or glass bottles, knives or firearms, explosives, pyrotechnic material, laser pointers, sprays, aerosols, selfie sticks, flag poles, motorbike helmets, cool boxes...
• Any object or element that may disturb, harm, or prevent the normal development of the activity.
• Professional cameras, video cameras or recorders, and drones.
• Trolleys, cool boxes, suitcases, or large bags.
Exempted from the above list are all materials necessary for duly justified medical reasons. By way of example, but not limited to:
• Crutches, walking sticks, or similar aids, only for people who, due to mobility reasons, must access the venue with such aids in order to move around.
• Aerosols or similar objects necessary by medical prescription.
These exceptions must be duly certified by a prescription or medical certificate to allow access to the venue with them. Under no circumstances will Mad Cool Festival S.L. process any data related to such medical certificates, which shall be shown at the venue entrance pursuant to section 17 of these Conditions.
The Festival Organisation may deny access to persons carrying a counterfeit ticket, reserving the right to take appropriate legal action. A counterfeit ticket is understood to be any document created or modified with the intent to pass as genuine or to alter its validity.
The ticket has different security measures. The Organisation is not responsible for tickets not purchased at the official points of sale mentioned in these general ticket sales conditions.
All tickets must meet the minimum conditions to pass the Festival access control so that they can be read electronically by the validity of the code printed thereon, as established in the previous paragraph.
It is also essential to carry at all times the national identity document, or for non-Spanish nationals, documents proving identity from their country of origin (NIE, passport, …).
Take care of your wristband to keep it in perfect condition. It is durable, but not unbreakable. Keep your wristband when leaving the venue as you will need it to re-enter and to request the refund of the remaining wristband balance once the Festival ends.
The Organisation shall adopt the technical and organisational measures it deems appropriate to ensure security at Festival access and to prevent possible fraud arising from duplicate tickets. In any case, the Organisation shall ensure the absence of arbitrariness and non-discrimination in the application of such measures, acting according to objective criteria through its coding and access control systems, such as the prior validation of an identical access code.
In any case, attendees are advised not to publish their ticket on social networks, not to print it in insecure places, and not to provide their data to third parties, in order to avoid possible fraud.
Attendees are not allowed to wear clothing with ideological references that may be offensive.
Attendees are not allowed to access the Festival with items displaying racist, homophobic, or intolerance-related symbols towards any group.
7. Food and Drink at the Venue
At the Festival venue, access with food and drink is permitted provided that the purpose is not to make such food and drink available to groups.
For safety reasons, drinks are permitted provided they are in containers made of recycled material, plastic, or similar, and without a cap.
Within the venue, there will be various stands where a wide variety of food and drinks can be purchased.
Within the venue, there will be a series of points, free of charge, providing drinking water.
8.Cancellations and Substantial Changes
If the Festival is suspended or substantially modified, users will be entitled to one of the following two options:
The total or partial refund of the amount paid for the tickets, except for expenses not related to the main provision (access to the event).
Request a voucher for the next edition of the Festival. A voucher is understood as a ticket equivalent to that acquired for the suspended or modified Festival edition, without any additional cost.
If the Festival is suspended or substantially modified once the show or recreational activity has started due to force majeure not attributable to Mad Cool Festival S.L., no refund of the ticket price will be made.
In the event of cancellation or substantial modification of the Festival with the right to a refund of the ticket price, such refund will be made as follows:
Through the ticket sales platform where the User purchased the ticket. This platform must refund the amount paid, except for handling fees, within the period established according to the legislation in force at that time.
Depending on each case, the Organisation will inform the attendees of the procedure to request the refund so that it can be carried out correctly.
9. Programme Changes
Due to setbacks or fully justified causes entirely external and unrelated to the will of the Organisation that force it to modify or alter the characteristics of the Festival as initially planned, it will make its greatest efforts to find the most favourable alternative for the attendees and the correct development of the Festival and will adopt the necessary measures for this, always aimed at meeting the expectations expected by consumers.
In the event that the modification to which the Organisation is forced due to causes beyond its control implies a substantial change in the characteristics of the Festival, consumers will be informed of such circumstance as soon as possible, so that they have the possibility to exercise their rights under the terms provided in the previous condition. In the event that any of the above-mentioned cases or modifications occur, the Organisation will make its greatest efforts and will make all possible means available to adjust the schedules and carry out the announced Festival programme.
The purchaser knows and accepts that the Festival is a multi-artist event and that, despite Mad Cool Festival S.L.'s commitment that the shows start at the announced time, reasonable adjustments in schedules may occur due to exceptional circumstances, under the terms provided in Article 22 of Law 17/1997 of 4 July on Public Shows and Recreational Activities.
The purchaser knows and accepts that the event subject to this ticket is a multi-artist music festival which, by its own nature and configuration, taking into account the limited time of the Festival, may involve the holding of simultaneous performances on different stages.
10. Safety and Health
The Organisation confirms that it complies with current legislation on safety, holding the necessary measures and personnel to guarantee the safety of all attendees.
Any type of assault, theft, or criminal behaviour must be immediately reported to the security personnel, who will take the appropriate measures.
The Organisation will not be responsible, except in the case of intent or negligence by the company, directly or indirectly for assaults, thefts, pickpocketing, etc., that may occur inside the venue or its surroundings. These must be reported to the competent authorities.
There will be a "lost property" point within the Festival. Once the Festival has ended, all items will be taken by the Organisation to the nearest police station of the Venue.
11. Minimum Age and Minors
The age to be considered is the age at the time of the Festival.
The Organisation reminds that the minimum age established in the regulations of the Community of Madrid for access is 18 years. Exceptionally, entry of minors under 18 years is allowed only during live performances. Once these are finished, minors under 18 must leave the venue.
Minors under 16 years may access and remain in the venue, provided they are accompanied by their father, mother, guardian, or person duly authorised by them, who must ensure their safety and correct behaviour during their stay in the Festival venue. The authorisation can be downloaded here.
Children under 8 years old (inclusive) may access the event free of charge, as they will not pay for a ticket.
Minors under 18 years will not be allowed to purchase or consume alcoholic beverages, products intended to be smoked, inhaled, sucked, or chewed, made wholly or partially of tobacco, or products that imitate it or induce the habit of smoking, or are considered harmful to health by the competent authorities. Likewise, the purchase and consumption of any substance that may harm health, create dependency, or produce euphoric, depressive, or hallucinogenic effects is prohibited. Any minor who acquires or consumes any of the above substances will be expelled from the Festival.
The procedure and access rules for minors are as follows:
• Minors 0 to 8 years (inclusive): Do not need a purchase ticket to access the venue. They must obtain a specific wristband to be collected at the Festival entrance. They must access and remain always accompanied by their father, mother, or legal guardian, or, if these cannot, by an adult authorised by their father, mother, or legal guardian. The authorisation can be downloaded here.
• Minors 9 to 15 years (inclusive): Need a purchase ticket to access the venue. They must access and remain always accompanied by the father, mother, or legal guardian, or, if these cannot, by an adult authorised by their father/mother or legal guardian. The authorisation can be downloaded here.
• Minors aged 16 and 17: Need a purchase ticket to access the venue. They do not need to be accompanied by an adult.
The adult father/mother, legal guardian, or authorised person accompanying the minor must have a ticket/wristband to access the Festival.
Also, for minors from 14 years onwards, it is mandatory to carry at all times the national identity document or, for non-Spanish attendees, documents that prove the identity of their country of origin (NIE, passport, etc.).
12. Capacity limitation
The different areas of the different stages of the Festival have a legally established limited capacity. Once this limit is reached, access to these areas will be cut off, informing attendees in advance and for this reason. Consequently, the Organisation will not be responsible in any case for the impossibility of certain attendees to attend specific concerts or events included in the Festival.
13. Prohibition of Ticket Resale
The resale of any ticket is prohibited. All tickets purchased at official Mad Cool Festival S.L. points of sale by bank card or PayPal grant the right to access the Festival to the purchaser of the ticket as its holder, regardless of whether the holder's details are indicated on the ticket itself.
In any case, the original purchaser of the tickets may transfer them to their relatives (family, friends, colleagues, etc.)
1. provided that the transfer is free or by merely reimbursing its price without increase;
2. that the transfer is made directly without intermediaries, resale pages, or second-hand sales, etc.
The Organisation may subject the tickets to an identity check of the bearer, either through QR access readers at the Festival or by other means of identification.
Due to the prohibition of resale, all Mad Cool Festival tickets acquired through any resale channel, second-hand, unofficial points of sale, etc. are fraudulent. Consequently, if a purchaser resells any ticket unauthorisedly, all tickets acquired by them will lose all rights associated with them, including access to the Festival, without right to a refund of the amount paid.
Additionally, without prejudice to possible civil and/or criminal liabilities and subsequent claims for general damages caused to Mad Cool Festival S.L., the reseller must indemnify the Organisation for all damages that such unauthorised resale could cause.
Given the profit-oriented purpose of resale, resellers are not protected by the General Law for the Defence of Consumers and Users under the DSA (Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market for Digital Services and amending Directive 2000/31/EC – Digital Services Act).
14. Prohibition of the use of tickets for advertising purposes
Possession of this ticket does not entitle its holder or third parties to use it, or its content, for advertising, marketing, or promotion purposes (including raffles, competitions, and/or gifts) associated with the ticket holder or third party, without prior consent of Mad Cool Festival S.L.
Non-compliance with this point will allow the Organisation to exercise civil, criminal, and/or administrative actions against the advertiser and/or unauthorised user, without prejudice to subsequent claims for general damages caused to Mad Cool Festival S.L., who must indemnify the Organisation for all damages that such unauthorised use could cause.
15. Industrial and intellectual property rights
Attendees acknowledge and accept that the Organisation holds and is the owner of all intellectual, industrial, and image rights, directly or indirectly, of the representations and artistic performances or any others that take place on the occasion of the Festival, without territorial or temporal limitation, and without any other limitation than those provided in current regulations.
Consequently, it is strictly prohibited, for commercial or advertising publication or dissemination, to capture, record, or film images or sounds without the prior written authorisation of the Organisation. Image or recording capture is only allowed for exclusive private and personal use by the user.
16. Assignment of image rights
Attendees acknowledge and accept that they may appear in images and/or recordings taken by different means for the subsequent dissemination and/or advertising of the Festival through any medium for informative and/or promotional purposes of Mad Cool Festival S.L., and accept such use by the Organisation.
It is informed that such images may be merely accessory, panoramic, general photographs, or of public interest, and similar, as well as those expressly agreed with the user, understood as interviews conducted with and consented by the user. In no case will a close-up of one or more persons be made for the purposes described here without their consent.
Therefore, attendees authorise the Organisation to use and exploit the aforementioned images and/or recordings that may be made only during the Festival and their subsequent dissemination for the purposes indicated in the previous paragraphs.
All this without prejudice to the possibility of users exercising their corresponding rights of access, rectification, deletion, restriction of processing, portability, and opposition. 21. Miscellaneous
These General Conditions expressly regulate the relationships arising between Mad Cool Festival S.L. and the Purchasers.
All these terms and conditions are governed by Spanish and European law, and any conflict arising from any operation with Mad Cool Festival S.L. will be subject to the exclusive jurisdiction of Spanish courts.
If any clause included in these general conditions is declared, totally or partially, null or ineffective, such nullity or ineffectiveness will affect only that provision or the part of it that is null or ineffective, the general conditions remaining in all other respects, considering such provision, or the part of it affected, as not included.
22. Legal Reservation
All attempts of fraud, trespass and/or damage to private property caused directly or indirectly to the Organisation authorise it to take the legal measures, both civil and criminal, that it deems appropriate against the perpetrators.
