It is important for you to know what personal information Mad Cool Festival S.L. (referred to in this document as 'we' or 'Mad Cool Festival S.L.') collects about you, and how we use it.

We have made every effort to keep our explanations brief and easy to understand. However, if you would like additional information or have any questions or concerns, please contact our Data Protection Officer using the details provided in the 'Contact' section below.

We will inform you appropriately if we make any material changes to our privacy practices at any time. If necessary, we will also ask for your permission.

Privacy Notice

Our Privacy Notice has been designed with you in mind. How the notice applies to you will depend on how you interact with us. For example, if you:

1. You purchase a ticket for one of our events, we will use the information you provide to fulfil our obligations to you in the provision of that service, and, where you have instructed us to do so, to keep you informed of other events that may be of interest to you; and

2. When you browse our sites we will use cookies to personalise your experience and to hopefully provide you with a seamless experience.

What Information We Have and Where We Get It

  • When you create an account or purchase a product (such as a ticket, or merchandise) from us, we will collect your contact and billing information.
  • When you purchase tickets for one of our events, or for an event we co-promote, we will receive your information from the ticketing agents used to sell tickets for the events we promote and co-promote, or for the venues we hire for the staging of the event. This will include your name, contact details and ticket purchase information such as the number of tickets purchased and seat number(s).
  • When you attend one of our events, we may collect information from you (i) through video surveillance cameras (we use warning signs where these cameras are in use), (ii) from our free Wi-Fi (if you sign up to use it) and, where available, through electronic payment wristbands that can be used to access events and to make purchases at the venue where the event is being held.
  • When you use our websites or apps, we will collect information such as the browser and device you are using, your IP address, your location, the site from which you accessed it, what you did and did not use our site/app for, or the site you access after visiting our site/app. For additional information on how we collect this information, please see our Cookie Policy
  • When you use a social media feature within our website or app and make a social media post, the social media site will provide us with some information about you.
  • If you have any accessibility requirements, we want to ensure you have the best experience when attending events. To do this, we will need to collect details of your requirements (which may involve you providing us with information about your mental or physical health).
  • On the rare occasions when we collect personal information from children, we always seek parental consent and, in any event, we will collect such information only for the purposes specified at the time of collection.
  • We use providers that collect geo-demographic data to help us more effectively personalise the services we provide to you. If you prefer that we do not do this, see the 'Your Rights and Choices' section below.

How we use your information and why

In this section we explain how we use your information and the legal basis for this.

1 . For the performance of our contract with you

We use your information when you enter into a contract with us (for example when you purchase goods or a ticket) so that we can:

  • Process your order
  • Receive payment, and
  • Providing customer care.

2. For our legitimate business interests

  • To conduct market research and analysis to help us improve and customise our products and services.
  • For our marketing purposes, unless such marketing requires your consent (see section 3 below).
  • To send you customer service emails, including booking confirmations and event reminders.
  • To prevent or detect unlawful behaviour, to protect or enforce our legitimate rights or as otherwise permitted by law. For example, to ensure that tickets are received by genuine fans. Therefore, we may use your information to prevent ticket resale, misuse of our intellectual property (e.g. our trademarks or those of our Event Partners), fraud, or other crimes.
  • To create a profile about you to help us personalise our services to you. For example, if you purchase tickets to pop events and have agreed to receive marketing communications from us, we will let you know about other pop events that we think may be of interest to you.
    • In relation to your personalisation settings
      If we know you better, we can give you more of what you want. To make sure our messages and website are relevant to you, we create a user profile with the information we know about you and how you use our services.
    • How to deactivate personalisation
      Simply uncheck 'Allow personalisation' in your account settings. We will stop any personalisation and only use your data for essential services, such as fraud detection.
    • What happens if you deactivate personalisation?

This means that you will not receive any personal recommendations and any newsletters you have subscribed to will be generic (although if you have requested to receive alerts about specific artists or venues, you will continue to receive such information). 

      We will continue to engage in profiling activities where this is necessary to provide our services to you, for example, for fraud detection purposes and where you specifically request us to do so, for example, when you indicate an artist as a favourite.

  • To ensure the security of our operations and the operations of our Event Partners.

When you have given us your consent

  • To contact you with information or offers about our upcoming events, products or services - these communications may be made via email, push and web notifications, SMS, or social media. You may change your marketing preferences at any time; to do so, please see the 'Your choices and rights' section below. However, please note that in cases where there is a prior contractual relationship between both parties, we will also be entitled to send you these types of communications, and you may express your refusal at any time by sending your request to
  • To provide you with location-based services - such as through our festival apps, which allow you to see where you are on the map, so that we can use your location to send you push notifications about what is happening around you.
  • For crowd management analysis - some of our apps use crowd management software so we can see how many people are in a particular venue, or when bars are busiest. This helps us allocate our resources more efficiently. We turn it on a bit before the festival or event, and turn it off a bit after, so we don't track devices when we don't need to.
  • To send personalised marketing and advertising communications on our websites and app (see our Cookie Policy for further information.
  • To process your health data for the purpose of meeting your accessibility requirements, where specifically requested and where express consent is given.

Who We Share Your Data With and Why

  • Within the Live Nation Entertainment family of companies that provide services to us, such as marketing, profiling, reporting and technical support.
  • With our third party service providers (sometimes referred to as data processors), such as cloud computing providers who provide the IT infrastructure on which our products and systems are built.
  • With our co-promoters or event partners who organise or provide the particular services at a particular event (in accordance with their privacy policy).
  • With third parties who supply the products and services purchased by you (e.g., merchandise) so that they can process and fulfil your orders.
  • With government agencies or other authorised bodies, where legally permitted or required.
  • With any successor to all or part of our business.

Your Options and Rights

Your options

Once you have given us your consent you may withdraw your consent in accordance with the following.

  • To stop receiving marketing communications from us you can change your preferences in your account, follow the unsubscribe instructions in any of the emails we send you, or contact us and we will do it for you.
  • To opt-out of our use of cookies and tracking tools, please see our Cookie Policy.
  • To opt out of location tracking and push notifications, you can change the settings on your device or keep your location turned off. To stop receiving network push notifications you will need to use your browser settings.
  • To object to personalisation, you can change your preferences in your account. If this option is not available, you can contact us and we will do it for you.

Your rights

You also have rights about how your personal information is used, including the following:

  • Right to object to our processing of your data.
  • The right to request that your information be deleted or its future use restricted.
  • Right to request a copy of the information we hold about you.
  • The right to correct, amend or update the information you have provided to us (where you have an account with us you may also do this by logging into your account and updating your information).
  • Right to challenge any automatic decision we make about you. An automatic decision is a decision taken without any human intervention that has legal consequences (e.g. credit check). We do not normally make automatic decisions, but when we do we will make it clear that such a decision is being made.

Taking Care of Your Information

We have security measures in place to protect your information. The security measures we apply will depend on the type of information collected.

We will only retain your information for as long as is necessary to provide the services you have requested from us, for the purposes set out in this policy and for any other legal purpose for which we are required to retain the information. We will securely delete your information when it is no longer required for the above purposes in accordance with our company policies.

As part of a global group of companies, we use shared services, some of which are located outside Europe. At the same time, your information may be transferred internationally when world-class artists are touring, in order to provide you with a seamless experience.

When we carry out such transfers of information, we must emphasise that there are strict rules in place to ensure that your data continues to be protected to the highest standards. When we do so, we will ensure that we have appropriate security measures in place. If your information is transferred outside the European Economic Area, we will use one of the mechanisms set out below.

Information regarding consent to the processing of curriculum vitae data

MAD COOL FESTIVAL S.L. with VAT number nº B87381042, informs you that in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, and Organic Law 3/2018, of 5 December (LOPDGDD), of Spanish law, regarding the protection of natural persons with regard to the processing of personal data and the free movement of such data, that the personal data provided and collected when sending your application or CV, will be processed and included in the database of MAD COOL FESTIVAL S.L., where personal data is collected and stored for the sole purpose of taking part in the personnel selection, job vacancies and recruitment processes that are carried out.

The interested party grants their consent, this being the legal basis for the processing of their personal data for the aforementioned purpose. In the event of any modification of your personal data, we ask you to inform us by the same means for the sole purpose of keeping your job application or curriculum vitae up to date.

MAD COOL FESTIVAL S.L. guarantees the proper use of the information, and in particular, the full confidentiality of the personal data contained in our database, as well as full compliance with the obligations regarding the protection of personal data. Likewise, MAD COOL FESTIVAL S.L. guarantees that the data provided will not be subject to international transfer, nor will they be transferred to third parties unless required by law or with the prior consent of the owner. Your personal data will be kept for the minimum time necessary to comply with the purpose for which they were obtained, as long as you do not request their deletion.

In accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, and Organic Law 3/2018, of 5 December (LOPDGDD), of Spanish law; concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data, MAD COOL FESTIVAL S. L. undertakes to respect your confidentiality in the processing of your personal data, and informs you that you have the right to exercise your ARSULIPO rights (rights of access, rectification, deletion, limitation, portability and opposition) of your personal data by sending a written request, enclosing a photocopy of your ID card, addressed to our postal address: MAD COOL FESTIVAL.
